President Donald Trump's administration is planning to correct the definition of gender, and to roll back protections of transgenders under federal civil rights law. This would roll back on an action by the Obama administration.
The Obama administration recognized gender as a choice and not determined by sex at birth. Obama's policy sparked a national issue, over bathrooms, locker rooms, and more. A large portion of America opposed this change, sparking a backlash. According to the New York Times, The Department of Health and Human Services is going to "spearhead" Title IX. Title IX is a federal civil rights law that prohibits discrimination against gender in education programs that receive financial assistance from the government. The Department made it clear that the government agencies are going to use the correct definition of gender as determined "on a biological basis that is clear, grounded in science, objective and administrable.” The Department explained that there are two genders, male and female, and it would be determined by the genitals that a person is born with, according to the Times. The Department proposed a memo, reading, "Sex means a person’s status as male or female based on immutable biological traits identifiable by or before birth." the Department continued, "The sex listed on a person’s birth certificate, as originally issued, shall constitute definitive proof of a person’s sex unless rebutted by reliable genetic evidence.” This action would affect over 1.4 million Americans who claim to be "surgically or otherwise" instead of male or female, according to the Times.
